Question:

Is there a co-employer relationship required and does it impact sovereign immunity?

Answer:

No, there is not a co-employer relationship required.  The employees always remain the employees of the tribe.    We have gone to great effort to ensure that Tribal Sovereignty is preserved. 

Question:

 Is the Tribal Worker Benefits agreement considered a management contract?

Answer:

No.  Tribal Worker Benefits has no management authority of any kind.  Submission to legal review has revealed that we are in compliance with the NIGC, IGRA, and State Compacts.  We simply offer a professional service and there is no management of any kind.  Therefore, we are not required to be licensed or audited.  Although, if the tribe requires us to do so, we will submit to licensing and/or audits as they see fit.

Question:

Is there a limited waver of Sovereign Immunity required.

Answer:

No.  We have put this program together in the best interest of our client (the tribe).  We do not normally require a limited waver of sovereign immunity.  It may be required on an “off the res” tribal entity, but will be looked at on a case by case basis.

Question:

Are there any hidden fees?

Answer:

No, the Payroll Service, Human Resource Support, Safety Services & Work Comp or Tribal Work Benefits as we like to call it, are all included in the quote price.  Benefits Administration is also available at no additional fee if we act as your broker for those services.

Question:

 Will these services replace my existing staff?

Answer:

No.  Our services are designed to work with and support your existing staff to give them all the additional support and resources they may need.  In many cases, we may provide additional staff onsite, at our expence, to give your team the additional support they may need.

Question:

 Will this program cost more than my existing work comp policy.

Answer:

Our program is competitively priced.  Plus we offer a 1/3 safety rebate!

Question:

 How long do I have to wait to receive my Safety Rebate? 

Answer:

Your Safety Rebate is calculated and paid annually within 60 days of your coverage anniversary or when claims are setteled.

 Can anyone get into the program?

Answer:

No!  This is an Exclusive Program for Qualified tribes and tribal entities only.
